This website is operated by Car Guy LLC, doing business as CarGuy. Throughout this website, the terms “we,” “us,” and “our” refer to CarGuy.

CarGuy provides this website, including all information, content, features, products, and services available through it, subject to these Terms of Service. Our store is hosted by Shopify, which provides the ecommerce platform that allows us to sell products to you.

By visiting our website or purchasing from us, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not access or use our website or services.

SECTION 1 – ELIGIBILITY AND ACCOUNTS

By using this website, you represent that you are at least the age of majority in your state of residence or that you have given permission for a minor dependent to use the website under your supervision.

You agree to provide accurate, current, and complete account, billing, payment, and shipping information.

You are responsible for maintaining the confidentiality of your account credentials and for all activity performed through your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 – PRODUCTS

We make reasonable efforts to display product descriptions, photographs, colors, specifications, and pricing accurately. Product colors and appearance may vary based on your screen, device, lighting, and display settings.

Because many CarGuy products use embroidery and other production processes, minor variations may occur between individual products. These variations are not necessarily defects.

Product descriptions, availability, pricing, and quantities may be changed without notice. We reserve the right to discontinue products or limit quantities sold to any person, household, geographic area, or jurisdiction.

SECTION 3 – ORDERS

Submitting an order constitutes an offer to purchase. We reserve the right to accept, reject, limit, or cancel an order for legitimate business reasons, including suspected fraud, pricing errors, inventory errors, payment problems, or unauthorized resale.

An order is not accepted until payment has been successfully processed and we provide confirmation.

If we change or cancel an order, we will attempt to notify you using the email address, billing address, shipping address, or telephone number provided with the order.

Please review your order carefully before submitting it. Requests to change or cancel an order are not guaranteed after processing or shipment has begun.

Returns, cancellations, and refunds are governed by our Return and Refund Policy, available through the footer of this website.

SECTION 4 – PREORDERS

Preorder merchandise is charged when the order is placed.

Estimated preorder shipping dates are based on current production schedules and may change because of manufacturing, transportation, carrier, or other delays.

If a preorder cannot ship by the promised date, CarGuy will notify affected customers and provide the option to accept the revised shipping date or cancel the preorder for a full refund.

A preorder may be canceled for a full refund before it ships by contacting hello@wearcarguy.com.

If an order contains both preorder and in-stock merchandise, the complete order may ship together when the preorder merchandise becomes available.

SECTION 5 – PRICING AND PAYMENT

Prices, discounts, and promotions may change without notice. The price charged will be the price shown when the order is placed and will appear in the order confirmation.

Unless expressly stated otherwise, product prices do not include taxes or shipping charges.

You agree to provide accurate and complete payment information. You represent that you are authorized to use the payment method submitted and that all charges incurred through that payment method will be honored.

We reserve the right to correct pricing, promotional, inventory, or product-information errors. If an error affects an order that has already been submitted, we may contact you for instructions or cancel and refund the affected order.

SECTION 6 – SHIPPING AND DELIVERY

Orders are shipped according to our Shipping Policy, available through the footer of this website.

Processing and delivery estimates are not guarantees. CarGuy is not responsible for delays caused by carriers, weather, incorrect addresses, customs processing, holidays, emergencies, or circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. Additional charges may apply when an order must be returned or reshipped because of an incorrect or incomplete address.

SECTION 7 – RETURNS AND REFUNDS

Eligibility requirements, deadlines, return-shipping responsibilities, damaged-order procedures, and refund timing are explained in our Return and Refund Policy.

Original shipping charges are nonrefundable unless required by law or the return results from merchandise that arrived damaged, defective, or incorrect.

SECTION 8 – INTELLECTUAL PROPERTY

The website and its contents—including CarGuy names, logos, slogans, designs, photographs, graphics, text, videos, product names, and other materials—are owned by or licensed to CarGuy and are protected by applicable intellectual-property laws.

You may use the website only for personal, noncommercial purposes. You may not reproduce, distribute, modify, display, publish, transmit, sell, license, scrape, or commercially exploit website content without prior written permission from CarGuy.

“CarGuy,” the CarGuy logo, “Built for the People Behind the Deal,” “Respect the Grind,” and other CarGuy branding may not be used without prior written permission.

Shopify’s names, logos, products, and services are owned by Shopify. Other names and trademarks appearing on the website belong to their respective owners.

SECTION 9 – OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to tools, applications, payment services, social-media features, or other services operated by third parties.

Third-party tools are provided on an “as is” and “as available” basis. We do not control or guarantee these services and are not responsible for losses arising from their use.

Your use of third-party services may be governed by separate terms and privacy policies provided by those third parties.

SECTION 11 – RELATIONSHIP WITH SHOPIFY

CarGuy is powered by Shopify, which provides the ecommerce platform used to operate the store.

Sales made through this store are transactions directly between the customer and CarGuy. Shopify is not the seller and is not responsible for products sold by CarGuy or for injuries, losses, disputes, or damages arising from those products or transactions.

SECTION 12 – PRIVACY

Personal information collected through this website is handled according to our Privacy Policy, available through the footer of this website.

Because Shopify hosts the store, Shopify may collect and process information relating to your access and use of the website. Information may also be shared with payment processors, shipping providers, analytics services, and other service providers as necessary to operate the store and fulfill orders.

SECTION 13 – REVIEWS, FEEDBACK, AND SUBMISSIONS

If you submit reviews, photographs, comments, ideas, suggestions, or other content to CarGuy, you grant CarGuy a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, distribute, and display that content for operating, improving, and promoting the business.

You represent that you own or have permission to submit the content and that it does not violate another person’s intellectual-property, privacy, publicity, or other rights.

We may monitor, edit, refuse, or remove submitted content at our discretion. We are not required to maintain submissions in confidence, compensate the person submitting them, or respond to them.

We reserve the right to correct errors, update information, or cancel affected orders. If an order is canceled after payment has been collected, the applicable amount will be refunded.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

SECTION 19 – INDEMNIFICATION

You agree to indemnify and hold harmless CarGuy, Shopify, and their respective owners, affiliates, officers, employees, contractors, agents, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal expenses arising from:

• Your unlawful use of the website or services
• Your violation of another person’s legal rights
• Content you submit through the website

The current version of these Terms will remain available on this page.

We may update these Terms by posting a revised version. Material changes will be communicated when required by applicable law. The effective date of revised Terms will be the date stated with the updated version.
